RENTAL PAYMENTS: Renter agrees to pay to Numana Yarns as rent for the Rental Product the amount listed on the product rental page (“Rent”) for every 15 day period the Renter is in possession of the equipment. The 15 day rental period is inclusive of pick up and return dates. Rental Payment not pro-rated if the Rental Product is returned early. Numana Yarns, at their discretion, may extend the rental return date past 15 days for no additional cost in cases where the return date falls on a day where the shop is closed.
RENTAL PRODUCT CARE & MAINTENANCE
Looms:
- Store loom in a clean, dry place away from excessive moisture and sunlight.
- Do not place loom under extreme warp tension. It is also recommended to loosen tension while not in use.
- Loom will be returned with no remaining warp.
- Oil moving parts frequently with provided oil as per diagram.
- If wheel uses a poly cord drive band, it should be removed from tension while not in use.
- Tension springs require very little tightening. Tension should be loosened when not in use.
- If wheel folds for transport, use provided instructions for proper technique.
- Wheel will be returned with no remaining fibres on bobbin (except leaders).
SECURITY DEPOSIT: Prior to taking possession of the Equipment, Renter shall deposit with Numana Yarns a security deposit of four times the Rental Payment as security for the performance by Rental equipment of the terms under this Agreement and for any damages caused by Renter to the Rental Product during the rental Term. Numana Yarns may use part or all of the security deposit to replace lost parts or repair any damage to Rental Product caused by Renter at the time of return. However, Renter is not just limited to the security deposit amount and Renter remains liable for any balance. Renter shall not apply or deduct any portion of any security deposit from the rental amount. Renter shall not use or apply any such security deposit at any time in lieu of payment of rent. If Renter breaches any terms or conditions of this Agreement, Renter shall forfeit any deposit, as permitted by law.
PICK UP AND RETURN TIMES: Rental Product is available for pick up and return between 11:00 am and 5:00 pm on or after the scheduled pick up and return dates. Late pick up will not extend the Rental Term.
POSSESSION AND SURRENDER OF EQUIPMENT: Renter shall be entitled to possession of the Rental Product on the first day of the Rental Term. At the expiration of the Rental Term, Renter shall surrender the Rental Product to Numana Yarns by delivering the Rental Product to Numana Yarns in good condition and working order, ordinary wear and tear excepted, as it was at the commencement of the Agreement.
CONDITION OF EQUIPMENT AND REPAIR: Renter has inspected the Rental Product and acknowledges that the Rental Product is in good and acceptable condition as per Product Condition diagram.
MAINTENANCE, DAMAGE AND LOSS: Renter will, at Renter’s sole expense, keep and maintain the Rental Product clean and in good working order and repair during the Rental Term. In the event the Rental Product (or any of it’s parts) is lost or damaged beyond repair, Renter shall pay to company the replacement cost of the Rental Product (or any of it’s parts) for the amount equal to the current retail replacement cost; in addition, the obligations of this Agreement shall continue in full force and effect through the Rental Term.
OWNERSHIP: The Rental Product is and shall remain the exclusive property of Numana Yarns, and is not available for sale.
SEVERABILITY: If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect. If any provision of this Agreement is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.
ASSIGNMENT: Neither this Agreement nor Renters rights hereunder are assignable except with Numana Yarns prior, written consent.
BINDING EFFECT: The covenants and conditions contained in the Agreement shall apply to and bind the Parties and the heirs, legal representatives, successors and permitted assigns of the Parties.
GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta.
NOTICE: Any notice required or otherwise given pursuant to this Agreement shall be via email with read receipt. Either party may change such email addresses from time to time by providing notice as set forth above.
ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the Parties and supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement. This Agreement may be modified in writing and must be signed by both Renter and Numana Yarns.
CUMULATIVE RIGHTS: Renters and Numana Yarns rights under this Agreement are cumulative, and shall not be construed as exclusive of each other unless otherwise required by law.
WAIVER: The failure of either party to enforce any provisions of this Agreement shall not be deemed a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. The acceptance of rent by Numana Yarns does not waive Numana Yarns right to enforce any provisions of this Agreement.
INDEMNIFICATION: Except for damages, claims or losses due to Numana Yarns acts or negligence, Renter, to the extent permitted by law, will indemnify and hold Numana Yarns and Numana Yarns property, free and harmless from any liability for losses, claims, injury to or death of any person, including Renter, or for damage to property arising from Renter using and possessing the Rental Product or from the acts or omissions of any person or persons, including Renter, using or possessing the Rental Product with Numana Yarns express or implied consent.
30 DAY PRODUCT DISCOUNT OFFER: For a period of 30 days starting the day after the Rental Product is returned, Renters can purchase a similar style of product and apply 60% of the Rental Rate (excluding GST, Late Charges, and Maintenance, Damage or Loss related expenses). Renter can request a coupon code for this value at any time in this 30 day period.
Ashford's Sampleit Loom is available to rent in the 40 cm (16")width, in-store only (no shipping). If you choose to order any Ashford loom within 30 days of returning your rental, you can apply 60% of your rental price to the new loom.
Rental period is for 15 for $30. Product must be returned in the same condition as when it was rented. If you are renting your loom for a class, select your start day for the first day of class and we will have your loom ready for you. A refundable deposit for 4 times the rental cost will be charged at pickup.
